Terms & Conditions of Hire and Commission

1. Clients

Kumquat Lab typically works with:
- UK light festivals and light trails
- Business Improvement Districts (BIDs)
- Music festivals

2. Scope of Supply (Touring Artworks)

We provide a turnkey service including:
- Delivery to site (typically in a Luton van)
- Setup and de-rig by two Kumquat Lab crew members
- On-site coordination with event teams (e.g. fencing, access, electricity)
- Tools and manual pallet truck brought by us
- Phone support during exhibition and on-site troubleshooting within 48 hours if necessary

Note on insurance: We carry public liability insurance (PLI) of up to £10 million. However, the artworks themselves are not insured. Where vandalism risk exists, we assess the level of local security (CCTV, patrols, etc.) and apply a pricing uplift accordingly.

3. Site Infrastructure (Client Responsibility)

Clients are expected to provide:
- Electrical power (ideally 2P+E CEE socket 16A, uninterrupted)
- Access and permissions for vehicle delivery (e.g. parking for Luton van)
- On-site contact and coordination
- Security provisions (e.g. fencing, CCTV, night rounds)

4. Bespoke Commissions

Kumquat Lab also offers a design and fabrication service for permanent sculptural or light installations. While we are happy to offer informal advice post-install, long-term maintenance is notincluded unless contractually agreed.

Intellectual Property: Unless otherwise agreed in writing, all intellectual property rights in our artworks remain the property of Kumquat Lab.

5. Payment Terms

Touring artworks:
- 50% of the total fee payable to confirm the booking
- Remaining 50% due within 30 days of installation date

New commissions:
- 75% of the total fee split as:
- Remaining 25% due on completion

Late payment: Kumquat Lab reserves the right to charge interest in line with UK statutory interest (8% + Bank of England base rate) and claim reasonable debt recovery costs as per the Late Payment of Commercial Debts Act.

6. Cancellation

Cancellations must be submitted in writing.

- If cancellation occurs after deposit is paid, the deposit is non-refundable.
- If cancellation occurs within 30 days of installation, full payment remains due.
- Either party may cancel in the event of Force Majeure or mutual agreement.

7. Equipment Functionality & Support

Kumquat Lab guarantees the functionality of the installation at the time of setup. The local team may test the piece before opening.

During exhibition:
- We provide remote support via phone/email
- We commit to an on-site visit within 48 hours of being informed of a major issue
- If we are unable to resolve the issue on-site, we will deduct a fair portion of the hire fee to reflect the downtime, starting after the 48-hour window

This does not apply to issues caused by misuse or vandalism.

8. Documentation & Compliance

We can provide the following documents upon request:
- Risk assessments (RAMS)
- Technical specifications
- Structural reports
- Insurance certificates

9. Data Handling

We collect client contact data for project-related correspondence, invoicing, and internal CRM purposes. We do not currently operate a newsletter or marketing list. Data is handled confidentially and never shared externally.
